Delivery
What is delivery?
Delivery means voluntary transfer of possession from one person to another.
By general rule when the goods are taken from the possession of the seller and putting it to the possession of buyer or person authorized to hold them.
Possession due to unfair means is not a delivery.
⊙ Forms of delivery:
1. Actual Delivery:
When the goods are physically deliver to the buyer. Actual delivery is defined as when the good are transferred in the possession of the potential buyer or his authorised agent, in other words, when goods are physically put in possession of buyer delivery is said to be actual.
2. Constructive Delivery:
When the goods are delivered without any change in the custody or actual position of the thing.
Example: warehouse man of A agree's to hold a good on behalf of B at A's request.
3. Symbolic Delivery
When there is a delivery of thing by the way of transfer of something else that is delivery of good in the course of transit maybe made by handling over a document of title to good or keys or bill of landing etc.
